The exact scope of any engagement is agreed in writing (email, project brief, or proposal) before work commences.

3. Use of This Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

Attempt to gain unauthorised access to any part of the website or its infrastructure
Submit false, misleading, or malicious content through any form on this site

4. Client Engagements — Pricing & Payment

All project pricing is quoted in the agreed currency before work begins. Pricing on this website represents indicative starting points and may vary based on project complexity, feature requirements, integrations, and timeline.

A deposit may be required before project work commences
Milestone payments may apply for larger projects
Any changes to agreed scope will be discussed and priced before additional work proceeds
Invoices are due within the timeframe stated on the invoice
Late payment may result in work being paused until payment is received

5. Intellectual Property & Ownership

Upon receipt of full and final payment for a project:

The client receives full ownership of all custom code and assets created specifically for their project
Any third-party libraries, frameworks, or open-source components used remain subject to their respective licences
Andina Dev retains the right to reference the project as portfolio work unless otherwise agreed in writing

All content on this website (text, graphics, branding, code) is the property of Andina Dev and may not be reproduced without written permission.

6. Client Responsibilities

Clients are responsible for:

Providing accurate and complete project requirements
Supplying all required content, assets, credentials, and third-party access in a timely manner
Providing timely feedback during the review and revision process
Ensuring that any content they supply does not infringe third-party intellectual property rights
Compliance with all applicable laws in connection with their app or website

Delays caused by the client may affect agreed timelines. Andina Dev accepts no liability for delays resulting from late client input.

7. Revisions & Scope Changes

A reasonable number of revisions within the agreed project scope are included. Requests that materially change the original brief, add new features, or extend the scope of work will be treated as change requests and may be subject to additional fees. Any additional work will be quoted and agreed in writing before proceeding.

8. App Store Compliance

Mobile applications developed by Andina Dev are built to meet the guidelines of the Apple App Store and Google Play Store at the time of submission. However:

App store policies change over time; Andina Dev cannot guarantee future compliance without additional engagement
App store review decisions are made by Apple and Google independently; Andina Dev cannot guarantee approval
Clients are responsible for ensuring their app's content, features, and data practices comply with applicable app store policies and local laws
Clients are responsible for maintaining their own Apple Developer and/or Google Play developer accounts

9. Confidentiality

Both parties agree to keep confidential any sensitive business information, technical details, or trade secrets shared during the course of a project. This obligation survives the completion or termination of the project.

10. Warranties & Disclaimers

Andina Dev warrants that work will be completed with reasonable skill and care, and to the standard described in the agreed project brief.

This website and its content are provided "as is" without warranties of any kind, express or implied. Andina Dev does not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, Andina Dev's total liability to a client for any claim arising out of or in connection with a project shall not exceed the total fees paid by the client for that project.

Andina Dev shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunity, even if advised of the possibility of such damages.

12. Termination

Either party may terminate a project engagement by providing written notice. In the event of termination:

The client is liable for payment for all work completed up to the date of termination
Andina Dev will provide all completed work and assets to the client upon receipt of outstanding payment
Deposits are non-refundable unless termination is initiated by Andina Dev without cause

13. Third-Party Services & Links

This website may link to third-party services or websites. Andina Dev is not responsible for the content, privacy practices, or terms of any third-party service. Links are provided for convenience only.

14. Privacy

Your use of this website and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Changes to These Terms
